1. Scope
Welcome to ARTMERE. The terms "we", "us" and "our" refer to The Artmere UG (haftungsbeschränkt), a company incorporated under German law with its registered office at Cotheniusstraße 19, 10407 Berlin, Germany. ARTMERE operates this online store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience. The services are hosted on Shopify's ecommerce platform.
These Terms of Service apply together with our Privacy Policy and our Return & Refund Policy. They describe your rights and obligations when using our services. Please read these terms carefully because they contain important information about your rights. By visiting, interacting with or using our services, you agree to these terms. If you do not agree, you should not use the services.
Important consumer notice: Nothing in these terms limits or excludes any mandatory consumer rights that apply under the law of your country or state of residence. This includes mandatory rights available to consumers in the European Union, Canada and Australia, including the Australian Consumer Law where applicable. If these terms conflict with mandatory consumer protection law, the mandatory law prevails.
2. Eligibility and Customer Accounts
By agreeing to these terms, you confirm that you are at least 18 years old or have reached the age of majority in your country or state of residence. You also confirm that you have given us permission for any minor dependents under your supervision to use the services on devices that you own or manage.
To use the services, including browsing our online store or purchasing products, you may be asked to provide information such as your email address and billing, payment and shipping details. You confirm that all information you provide is accurate, current and complete. You are solely responsible for maintaining the security of your account details and for all activity under your account. You may not transfer, sell or license your account to another person.
3. Products and Descriptions
We make every reasonable effort to display our products accurately in the online store. However, colors and the appearance of artworks may vary from what you see on your screen because of differences in device settings, screen calibration and ambient lighting.
Every artwork sold through ARTMERE is a hand-painted original created by skilled artists. Because our products are handmade, minor variations between the preview image and the finished artwork are inherent in the process and do not by themselves constitute a defect. These variations make each piece unique.
Product descriptions may be changed at any time without notice. We reserve the right to discontinue any product and to limit product quantities on a case-by-case basis.
4. Formation of the Contract
The display of products in our online store is an invitation to place an order and does not itself constitute a binding offer. By submitting an order, you make a binding offer to purchase. You will receive an automatic order confirmation by email that only confirms receipt of your order. The purchase contract is formed when we send a separate acceptance confirmation or dispatch the goods to you.
Please review your order carefully before submitting it. You may cancel or modify your order within 48 hours of purchase at no cost, as described in our Return & Refund Policy. Your purchases are subject to the return, exchange and cancellation terms in that policy. You confirm that your purchases are for personal or household use and not for commercial resale.
5. Prices and Payment
Prices, discounts and promotions may change without notice. The price charged for a product is the price in effect when the order is placed, as stated in your order confirmation email.
For deliveries within the European Union, displayed prices include statutory value added tax at the applicable rate. The applicable tax rate and amount are shown during checkout and on your invoice.
For deliveries outside the European Union, import duties, taxes and customs or processing fees may apply unless expressly stated otherwise. Please review our Shipping Policy for more information.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases and to update your account information promptly. You confirm that the payment information you provide is accurate and complete and that you are authorized to use the selected payment method.
6. Delivery and Transfer of Risk
All delivery times are estimates and are not guaranteed. Delays may occur because of the handmade nature of our products, shipping issues, customs processing or events outside our reasonable control.
For consumers in the European Union and Germany, the risk of accidental loss or damage passes to you only when the goods are delivered to you, not when they are handed to the carrier, as required by applicable law. For consumers elsewhere, mandatory local consumer law governing delivery risk remains unaffected.

7. Intellectual Property
Our services, including all trademarks, text, displays, images, graphics, product reviews, videos, audio and their design, selection and arrangement, are owned by ARTMERE, its affiliates or licensors and are protected by applicable intellectual property laws.
These terms permit you to use the services only for your personal, non-commercial use. Without our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit any material from the services. All rights not expressly granted are reserved by ARTMERE.
8. Third-Party Tools and Links
You may be given access to third-party tools or services through the services. You acknowledge and agree that we provide access to these tools on an "as is" and "as available" basis without warranties or endorsement. We are not liable for your use of optional third-party tools.
The services may contain links to third-party websites. We are not responsible for the content or accuracy of third-party websites. If you access a third-party website, you do so at your own risk.
9. Shopify
ARTMERE is hosted by Shopify, which enables us to provide the services. Purchases from our store are made directly from ARTMERE. By using the services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales made between you and ARTMERE.
10. Privacy
All personal data that we collect through the services is governed by our Privacy Policy.
For customers in the European Union and Germany, we process personal data in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). Our Privacy Policy explains the nature, scope and purpose of this processing and your rights, including rights of access, correction, erasure, restriction, data portability and complaint to a supervisory authority.

By using the services, you acknowledge that information you submit may be shared with Shopify and service providers that may be located outside your country of residence to provide the services, as further explained in our Privacy Policy.
11. Customer Feedback
If you submit ideas, suggestions, feedback, reviews or other content, you grant us a perpetual, worldwide, sublicensable and royalty-free license to use, reproduce, modify, publish, distribute and display that feedback in any medium for any purpose, including commercial use.
You confirm that you own or control all rights required for the feedback you submit, that you have disclosed any compensation or incentive received in connection with the feedback, and that your feedback does not infringe the rights of any third party. We may monitor, edit or remove feedback that we consider unlawful, offensive, defamatory or otherwise objectionable.
For customers in the European Union and Germany, this license does not affect any inalienable moral rights under applicable copyright law.
12. Errors and Corrections
The services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers, shipping charges, delivery times or availability. We reserve the right to correct errors and to change information or cancel orders if information is inaccurate, at any time and without prior notice. If we cancel an order, you will receive a full refund of all amounts paid.
13. Prohibited Uses
You may use the services only for lawful purposes. You may not use the services, directly or indirectly, for unlawful or malicious purposes, including violating applicable laws or regulations, infringing intellectual property rights, harassing or harming another person, submitting false or misleading information, transmitting advertising or spam, impersonating another person, uploading viruses or malicious code, or collecting another person's personal data. We reserve the right to suspend or terminate your access if we determine that you have breached these terms, subject to applicable law.
14. Statutory Warranties and Consumer Guarantees
Your mandatory statutory warranty rights and consumer guarantees remain fully unaffected. For consumers in Germany, the statutory rights under Sections 434 and following of the German Civil Code (BGB) apply. If a product is defective at delivery, you may be entitled to repair or replacement, withdrawal from the contract, a price reduction and/or damages under applicable law. The statutory limitation period for warranty claims concerning new goods is two years from delivery.
For consumers in Canada and Australia, any mandatory statutory warranties, consumer guarantees and remedies available under applicable federal, provincial, territorial, state or national consumer protection law also remain fully unaffected.
15. Limitation of Liability
We have unlimited liability for damage caused intentionally or through gross negligence, for injury to life, body or health, and where liability is mandatory under product liability law.
If an essential contractual obligation is breached through ordinary negligence, our liability is limited to the foreseeable loss typical for the contract. Otherwise, our liability for ordinary negligence is excluded to the extent permitted by law. These limitations also apply to the personal liability of our employees, representatives and agents.
Nothing in this section excludes, restricts or modifies a mandatory consumer guarantee, right or remedy where doing so would be unlawful, including under the Australian Consumer Law where applicable.
16. Governing Law and Jurisdiction
These terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). This choice of law does not deprive a consumer of any mandatory protection granted by the law of the country or state of the consumer's habitual residence.
Where mandatory consumer law allows a consumer to bring a claim in the courts of the consumer's habitual residence, nothing in these terms limits that right. Otherwise, the competent courts are determined by applicable law.
17. Consumer Dispute Resolution
Under Section 36 of the German Consumer Dispute Resolution Act (VSBG), we are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless required by law.
18. Termination
We may terminate this agreement or your access to the services, in whole or in part, with reasonable notice where required by applicable law. You remain responsible for all amounts due up to the effective date of termination.
19. Severability
If any provision of these terms is found to be unlawful, void or unenforceable, that provision will be enforced to the greatest extent permitted by applicable law. The unenforceable portion will be treated as severed from these terms without affecting the validity and enforceability of the remaining provisions.
20. Entire Agreement
ARTMERE's failure to exercise or enforce any right or provision of these terms does not constitute a waiver of that right or provision. These terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and ARTMERE regarding your use of the services and replace any prior or contemporaneous agreements or communications on the same subject.
21. Assignment
You may not assign, transfer or delegate these terms or any of your rights or obligations without our prior written consent. Any attempted assignment without consent is void. We may assign, transfer or delegate these terms and our rights and obligations without your consent, provided that doing so does not materially reduce your rights under these terms.
22. Changes to These Terms
We may update or amend these terms by publishing the revised version on our website. For consumers in the European Union and Germany, material changes will be communicated at least 30 days before they take effect where required by law, and you may have a right to object. Continued use of the services after the changes take effect constitutes acceptance only to the extent permitted by applicable law.
